Obama’s Next Immigration Battle: Local, Federal Authorities on Collision Course over Detention

Last Tuesday, Chicago Mayor Rahm Emanuel held a press conference to announce that he didn’t want his city’s law-enforcement authorities to follow federal requests to hold some undocumented immigrants, picked up on other charges, for deportation. The national media’s ears perked up. Emanuel, a former Chief of Staff to President Obama, was at loggerheads with his old boss — good copy in the making. But on the same day, back in Washington, D.C., much bigger news was developing on the future of federal and local cooperation on immigration policy. John Morton, the director of Immigration and Customs Enforcement (ICE), told a House subcommittee that his efforts to persuade officials to honor any of ICE’s detention requests in the jurisdiction of Cook County, which includes Chicago, had hit a wall. “I won’t sugarcoat it,” he said. “I don’t think that approach is going to work in full.”

In April, Homeland Security Secretary Janet Napolitano told Congress she was “evaluating all options” to compel Cook County, Illinois, to go along with ICE’s requests, known as “detainers,” under a program called Secure Communities, launched in late 2008 to focus immigration enforcement on criminal aliens. Morton reiterated Napolitano’s warning, but his grim assessment of the Cook County situation added further gravity to the statement: “We’ve been exploring, as the Secretary has said, our options under federal law with the Department of Justice, and we will see where that goes.” Translation: the Obama Administration has discussed the possibility of suing a jurisdiction because it’s too lax in enforcing federal immigration priorities, a mirror image of the legal drama the Administration just went through with Arizona’s law, which the Supreme Court partially struck down in June.

Some advocates have framed nondetainer policies like Cook County’s as a response to the trend of aggressive state immigration crackdowns like the one in Arizona, which requires police to try to discern a suspected undocumented immigrant’s status during a routine stop or detention. That’s convenient politics, but in a much more direct way, they are a response to the rapidly expanding federal immigration-enforcement program, Secure Communities. Under that program, local law-enforcement agents send fingerprints of detainees to the FBI and ICE, which can then ask local jails to hang on to some prisoners eligible for deportation, giving federal authorities the chance to swoop in and remove them within 48 hours. It’s a wide net, which snags serious criminals, minor offenders and otherwise law-abiding undocumented immigrants — say, someone who has failed to appear in immigration court or who has been previously deported. And it’s putting its critics, who say Secure Communities encourages local law enforcement to arrest more Latinos and undermines cooperation between police and immigrant communities, on a collision course with the Obama Administration.

It’s not just Cook County, which stopped honoring any of ICE’s detention requests in September of last year, and the city of Chicago, which is considering a narrower ordinance directing jails not to comply with detainers for those convicted or suspected of minor offenses. On the same day that Morton testified before Congress, Washington D.C.’s city council unanimously passed a similar measure. Taos, N.M., already has one. Santa Clara County, California, has declined to honor the majority of the 1,400 ICE requests issued since October. The city of San Francisco has also declined a handful.

These figures are small compared with the vast scope of Secure Communities and the Administration’s wider immigration-enforcement efforts, which have produced more than 1.2 million deportations so far under President Obama. Since launching Secure Communities in late 2008, ICE has received 17 million sets of fingerprints, identified nearly 1 million undocumented immigrants, and deported nearly 200,000 of them. The growth of the program has been explosive. Criminal-alien removals increased 89% between 2008 and ’11, according to ICE, and more than 3,000 local jurisdictions now participate in Secure Communities, up from just 88 in 2009. ICE expects nationwide deployment in 2013.

But the number of jurisdictions resisting detention requests may soon grow too. On July 5, California’s senate passed a nondetainer policy for the entire state, which would restrict local law enforcement from going along with detainers for all but the most serious criminals. It is expected to pass the assembly next month before heading to the desk of Governor Jerry Brown, who has not said whether he will sign it. California has the largest population of undocumented immigrants in the U.S., and about 75,000 of those deported by ICE under Secure Communities have been from that state — far more than any other. It’s not clear what the Obama Administration would do if that crucial state bucked the program.

“The Administration has to be seen as opposing [these measures] as vigorously as they did the Arizona measure,” says Jonathan Turley, a law professor at George Washington University. “First to be consistent on principle, the Administration just argued before the Supreme Court that states should not be able to create detainer policies unilaterally and that the federal government should have overriding authority in the area.”

There’s a certain irony in the Administration’s Secure Communities dilemma, even beyond the Arizona parallel. While ICE has rebuked Cook County for refusing all detention requests — and releasing 222 undocumented immigrants flagged for deportation in the process — the policies that may soon arrive in Chicago and California (which ICE also opposes) seek to prioritize the removal of hardened criminals. That’s been the Administration’s stated goal from the outset, and why Obama recently announced legal relief for some young undocumented immigrants who entered the country as children.

But it’s also why the Department of Homeland Security (DHS) insists that Secure Communities is a good idea. As congressional appropriations for immigration enforcement have ramped up — ICE’s detention and removal budget doubled between 2005 and ’09 — deportations have shot up too. DHS argues that if the money has to be spent, it’s better used going after criminals than someone else. Secure Communities isn’t as narrowly focused as its critics would like, but it’s been amended on the fly — to reduce the number of traffic violators targeted, for instance — and DHS says the portion of deportees who’ve been convicted of the most serious crimes, now 27% in the federal government’s “level 1″ taxonomy, will rise over time.

That argument hasn’t been sufficient for immigration advocates, who worry police will arrest people on pretext just so they run their prints, not to mention the spike in deportations. Many local lawmakers still insist discretion over who is held should remain with local authorities. And it’s not certain that the Administration, should it decide to pursue legal challenges to nondetainer policies, would be able to make the same case it did against Arizona. While Congress mandated information sharing in 2002, Secure Communities was established by an appropriations bill in 2008. And while Morton now describes ordinances like Cook County’s as “inconsistent with federal law,” DHS documents acquired by advocacy organizations have suggested some ambiguity as to whether federal officials always considered detainers mandatory.

“As long as it’s not directly contradicting immigration law, then it’s not pre-empted,” Steven Gonzales, a constitutional law professor at the Phoenix School of Law, says of nondetainer ordinances. “It’s a fine, fine line, but there is some logic there.” Turley, of George Washington University, says there’s a crucial difference between taking unilateral action, like Arizona did, and declining to carry out federal requests. “I think it would be very difficult for the Justice Department to argue that states are impeding federal policy by not agreeing to be agents of that policy … that would be a serious threat to federalism and states’ rights.”

If legal action isn’t a credible threat, cutting off federal funds just might be. The Justice Department reimburses local jails for a part of the cost of holding detainees flagged for deportation, and provides a number of other law-enforcement grants. Morton hinted in his testimony that some of that funding may be subject to re-evaluation. “The power of the purse is definitely the strongest power that the government has,” says Aarti Kohli, a senior fellow at Berkeley’s Chief Justice Earl Warren Institute on Law and Social Policy. But Kohli is skeptical the Administration would even take things that far. “Politically, I don’t see what’s to be gained,” she says. It is always risky to snatch away federal funds in an election year.

If nondetainer policies move ahead and the Obama Administration doesn’t attempt to force jurisdictions to comply, Secure Communities is sure to be another piece of patchwork in the U.S.’s already mottled immigration policy.

The Cook County sheriff, Tom Dart, who says he doesn’t like having to release some of the detainees who’ve been flagged for deportation but has given up trying to persuade his county board and ICE to work things out, found the program to be inconsistent to begin with — its guiding principles impossible to discern. “We have this hodgepodge of rules and laws when it applies to detainers,” he says. “It was so ambiguous, the whole thing.” Ambiguity is a word he used more than once to describe the challenges of immigration enforcement.

That’s the way things are. Neighboring Arizona and California could soon have vastly different protocols for arresting undocumented immigrants and turning them over to federal authorities. “It really is a political issue, a struggle between different points of view,” says Gonzales. “And as long as Congress remains polarized and unable to move forward on comprehensive immigration reform, there are going to be leaks all over the ship … depending on what political environment you’re in around the country.”

 The last quote is basically a thinly-veiled threat: "until we get amnesty, there will always be gaps in the enforcement of immigration laws."  That kind of thinking sounds like nails on a chalkboard in a nation that deeply respects the rule of law as a binding characteristic of who we are.  I wish this writer would have interviewed someone like Kris Kobach or Mark Krikorian to balance out the quotes here.  He basically pits the Obama Administration against "immigrant advocates" even though the two groups more-or-less agree on the same policy ideals.

how can an illegal immigrant be law abiding? working unauthorized is a felony and if they got the job using a stolen i.d. or fake i.d thats a felony also ,wow 2 felonies ..if a citizen commits 1 felony its stays on his record for life and future job prospects become very limmited

If there is a law on the books dealing with illegal immigrants, ENFORCE THE LAW!!!

States have the authority to enforce these laws.  Why would the president object to having laws enforced?  I would really like to have this explained to me.  I must be missing something regarding our laws and the fact that they apparently are different for different people.... ???

Immigration laws should apply to every person who is not a U.S. citizen. No exceptions and the process should be exactly the same for every non-citizen.

This is not complicated at all. Just enforce the federal law as it stands. If you are illegal, then you are to be removed from this country. If local officals try to help illegals by hiding them or creating havens, then those officals should be locked up. Follow the law of the land, not what illegals and their suppoters think it should be.

Employers (IMAGE) program. Employers that sign up for IMAGE agree to: apply

E-Verify for new hires; undertake an I-9 form audit to expose illegal aliens

currently in the workforce; plus hold training sessions for human resource employees

on how to avoid hiring illegal aliens (e.g., on spotting document fraud). Since

IMAGE helps extract currently employed illegal aliens, it is considered the

best overhaul innovation for maintaining a legal workforce. After illegal-alien

drunk drivers slaughtered two citizens a few years ago, Milford officials begin

to scrutinize options for reducing illegal immigration. A third death last year

forced the town, and local state legislators, into action.

 

The state legislators from the area

led the charge on enforcement legislation that became law in Massachusetts this

week. Each few months counties and cities are learning about the significance

of E-Verify and what it would do for the overall populations of their

communities. However, salvos of rhetoric and lies have been spread about

E-Verify, the Legal Workforce Act (H.R. 2885). But even so E-Verify is spreading

--so fast and hundreds of thousands of business entities are now signed up.  Of course either sides one way or another are

courting the illegal alien invasion, whereas the Republicans to a lesser

extent. 

 

THE FED’S REFUSE TO ENFORCE

IMMIGRATION LAWS; OTHERWISE ILLEGAL ENTRY WOULD BE A FELONY?

 

What American citizens must be aware

of is the Democratic indifference to non citizens voting in our elections. The

Liberal airwaves, including TV and radio broadcast, then especially the media

deny this, but the avid reader can observe this for themselves. Just type into

any search engine ‘Voter Fraud’ and the truth will be hard to conceal,

certainly when Obama before being president, was employed by the notorious

ACORN canvassing organization. What went on in its ranks was a serious

violation of election laws.

 

With both the majority of the Democratic

and Republican base failing to enact a mandatory E-Verify law, it’s easy to

read between the lines why? Both political parties have been heavily corrupted

by either corporate influence or for the Democrats a whole host of adversaries,

as large radical minority groups, unions and even the church high

echelons.  Meanwhile low income Americans

are suffering, not excluding teenagers who once looked forward for a part time

job as it was in the not so distant past.

 

Today we have the Constitutional TEA

PARTY, the ‘People’s Party’ who are not just represented by white people as the

open border progressives would like you to think. The TEA PARTY is a mix of ordinary

decent citizens and green card holders of different skin colors, but with one

endearing agenda to rid us of illegal invaders; ObamaCare and everything that

qualifies to raise taxes. If you don’t already know anything about Obama’s

health care law, the hiring has begun for recruitment.  ObamaCare means to recruit least 400.000 enforcement

federal officers, which just adds up to the greatest expansion of Washington,

that America has ever seen under this Democratic Party. 

 

Doesn’t matter who is in control of

America; either for Obama for another term or his antagonist Mitt Romney? Both

must be held accountable by the TEA PARTY.

well in flushing out illegal aliens, the enforcement has slowed to a crawl. Not

just to gain points in the ethnic groups by bypassing Congress, undermining the

‘Rule of Law’ but by enacting a loosely effective Dream Act, so that the

illegal alien parents should be held accountable for their violating

immigration laws, but now the administration is placing a strain on certain

sectors of the border, by closing down entry ports. It’s all to do with votes

and where the Democrats they are unconcerned who votes, shown by the attitude

of the U.S. Attorney General Eric Holder. 

He is expanding his power by not only enforcing states who are enraged

they have to support their population of illegal aliens, but this nasty little

man is determined to let non citizens vote. He has attacked the sacred

sovereignty of not only Arizona, but Alabama, Georgia and a bunch of others,

who cannot sustain the huge financial burden of education, schooling, low

income housing, benefits for low income Mothers, cash payments, children’s

breakfast and lunch at school, interpreters for bilingual education and a great

deal more welfare programs, that foreigners have been allowed to consume;  which citizens cannot even touch.

 

While you’re working to pay your

annual taxes to cover the cost of Obamacare, the IRS will be extorting even

more money from you to pay for the free health care of illegal aliens, plus

unknown numbers of ‘freeloaders’  and we

know there are plenty of them. If Obama gets his way, a person will not even to

have some reasonable excuse to gain acceptance for food stamps? Eventually we

will turn into another country like Greece and the flow of the money from the

government coffers, taxpayers will not be able to contribute enough funds to a

least balance our debts.

 

Other than the exception of highly

paid immigrants holding PhDs ‘s in science, technology, engineering and mathematics

(STEM), who should be given expedited preference visas, all others should be

deported. America has become a magnet from over 20 million plus foreign

nationals, who have ignored our laws and through corporate favors both parties

are handing out a million new visas annually than low skilled recipients.  Then illegal females have hooked up to a free

pass, by smuggling unborn children into this sovereign country. The 14th

Amendment has mutated, that originally was for the emancipation of slaves and

now used to allow pregnant females to gain a ‘foothold’ into the U.S. This is

the inception of the Dream Act of illegal parents bringing unborn babies into

America. Once here the female can then receive free health care, education for

the child that is costing taxpayers a hundred billion dollars a year. The

Birthright Citizenship bill (H.R. 140) sitting in Congress, should be

passed—instead its gathering dust in some legislators filing cabinet.  

 

Time to wake up the politicians in

Washington and inform them all, they are swaying on a tightrope. That tightrope

is the TEA PARTY and they are quietly infiltrating both political parties. YOU

THE VOTER CAN ALSO CONTRIBUTE BY INVESTIGATING YOUR LOCAL POLITICIAN AND THEN

VOTING THEM OUT ACCORDING TO HIS UN-AMERICAN PLANS. THE TEA PARTY LEADERSHIP

because the government is badly flawed and remained unconcerned of the

disastrous invasion.

 

There should be no acceptance of the

illegal immigration invaders and the TEA PARTY agenda will have as many leaders

they can fit into the seats in the Senate and House of Representatives, to do

With the President's attacks against Romney and Joe Biden's, thus far, successful tour, the Dems political tactics will undoubtedly sway many to vote Democratic. In my opinion, the Latino vote will perhaps be the main point of contest between both candidates, seeing that their population size, distribution, and political tendencies stem from a unique socioeconomic context.  Here is a map showing the population size and distribution of Latino's in the United States in 2010 (US Census Data):

Sorry about state and local situations not being condusive to good politics or saving hassles, but the federal government is doing what it should so...deporting illegal aliens except those deserving ones excepted by the Obama policy.  It hurts both Democrats and Republicans in some cases, but it is an attempt to follow the national law, with some compassion thrown in.

When you hack off both sides, you're often doing something right....compromising on key issues.

This administration is all smoke and mirrors.  While giving the impression that the Cook County regime is at loggerheads with the Obama administration it is in fact just the opposite.  It gives the appearance of bucking the status quo when in fact all they are doing is posturing for the media and liberal moguls in an attempt to distract from the actual program of Obama's.  If they can convince the media and liberal and even the conservative parties that there is an impass they will have achieved their purpose.  This tactic is only a stalling tactic which will allow the Obama administration to move forward with its own agenda while sowing confusion and a time consuming effort of the various parties to fight and argue with each other.   This is just another way for the Obama Regime to buy time and create more disharmony amongst the different factions.  The unfortunate part is that the uninformed will buy into it as another slight against the misunderstood Obama administration.   It is time for the Obama-bots neeed to wake up and know when they are being used!

Along with this situation and the fact that the DOJ was not quick to slap a lawsuit on any of those jurisdictions, the political ad's pandering to the Latino community say volumes. They are even running government ads in Spanish in Latin nations explaining how to apply for US government benefits.

Since Obama made his announcement in Columbia that he would do everything he could to pass amnesty and the DREAM Act, there is a rush of people coming from Central and South America. There are far larger numbers of un-escorted minors turning up on the border and even more shrill calls for Obama to unilaterally revoke immigration laws.

What America saw in 1986 was amnesty encouraging illegal immigration, not stopping it. Any number they give of people affected by any laxity on immigration laws will always be doubled or tripled. It is already happening with Obama's executive order as an example. 800,000 is now closer to two to three million.

If Obama really wants half of Latin America to come here any way they can, he is definitely using the right bait. They talk of  "dog whistle politics"?

The words "US Amnesty" in Latin America are a dinner bell.

In sum, when the Obama administration picks and chooses which laws to enforce and which parts of which laws they will or will not enforce, it won't be long before more states, cities, counties, and even small towns decide to "pick and choose" which laws they will or will not enforce.

Obama's "deportations" figure include criminal deportations as well as apprehensions at the border, and those removed after having been identified as illegal aliens while they were incarcerated.

The Sourcebook of Criminal Justice shows 387,000 deportations in 2010, of which 166,000 (44% ) were conducted under the Criminal Alien Program. CAP identifies illegal aliens already in federal or state prisons and processes them for removal. This should not be confused with or counted as removal from the general population.

Apprehensions at the border are no longer disaggregated or even specifically identified as such.  However, if one goes back to 2005, the category of "Attempted Entry" accounted for 36% of the total number of  "deportations."  If this percentage has held steady in that ballpark over time, then CAP and border apprehensions together account for about 80% of the deportations attributed to Obama by way of action by ICE .

The "record number of deportations" claim continues to be circulated without anyone looking at real data. When Obama was asked to explain how he can downplay the number of deportations when he is talking to illegal aliens and their enablers, but play up the numbers when talking to the general populace, he said, "It's complicated."  And that's the best explanation our chief exec can give us!

Daddy always told me there are lies, damned lies, and statistics. It's a crying shame that investigative reporting has gone the way of the dinosaur.  Heck, by now, we'd be happy with a little critical thinking.

Undocumented aliens for decades have been able to evade detection but now technology is beginning to catch up with them - as indeed it is with all of us. If an alien is caught in a net why wouldn't that unauthorized foreign national NOT be brought to justice? Illegal immigrants are subject to deportation just as tax evaders are subject to fines and jail time. The Justice Department and Congress need to punish cities and states that fail to assist in the repatriation of undocumented aliens.

First check the source(s) of that assertion.  Second, check your reading comprehension. While illegal entry from MEXICO may be down and voluntary repatriation up (and those claims are even doubtful since so much of the "data" is merely anecdotal and/or received from the Mexican government and its funded agencies, and the US sources are clearly biased) illegal entry from Central America is skyrocketing.  NO ONE is saying anything about how many are over-staying temporary visas, a topic Napolitano consistently avoids.

Now, living in Kansas, my disability has been getting me my ballot mailed to me at home; but since Governor Brownback, like many other GOP governors, has decided to make it much harder for poor, minority, and disabled Americans to vote, I may have to go to the polling station in my wheelchair, taking with me my (expired) American passport, and/or my Certificate of Naturalization.

Instances of voter fraud have been shown to be fewer than 1 in 100,000, but Republican governors like Florida's Rick Scott have decided to disenfranchise many, many Americans, including an elderly Army veteran who has voted in every election since 1945. They've done this in order to lower the vote count among Americans they think likely to vote for Democratic candidates, a clear violation of the Constitution. But there may not be enough time before November to get a Federal Court to declare the tactic so; therefore, the tactic may work. Shame on you, Republican governors, for coming up with a political solution to a non-problem. You've given your opponents in your next election a wonderful issue to use against you. Your few constituents won't forget--we GOTV believers won't let them.

The Supreme Court ruled in favor of federal immigration policy, as superior to immigration law. Even if a state wants to adopt federal law, as it's own, states can't do this if it's against federal policy.  If it's the federal govt's policy to deport people, then deport them.

Remember to vote AGAINST the politicians that support ILLEGAL migrants, over LEGAL residents.
