The Cornhusker Kickback Take 2

A conservative Democratic senator is a hold out, and possibly deciding vote, on pivotal legislation that tops the President’s agenda. He had a deal that benefits his Midwestern state, but it was taken out and now his attempts to put it back in and the substance of the deal itself is drumming up a bit of controversy. The Cornhusker Kickback, they’re calling it. Sound familiar? No, I’m not talking about Nebraska Senator Ben Nelson and health care reform. I’m talking about Nebraska Senator Ben Nelson and financial regulatory reform.

Nelson has been the lone Democrat opposing financial reregulation legislation all week. He’s upset that a carve out that would benefit Warren Buffett’s company, Berkshire Hathaway – which is based in Omaha, was stripped form the derivatives package negotiated by Senate Banking Committee Chairman Chris Dodd and Senate Agriculture Committee Chairman Blanche Lincoln. Immediately, the press labeled Nelson’s request a sweetheart deal and noted the senator owns anywhere from $1.5 million to $6 million in Berkshire Hathaway stock. Nelson, of course, was incensed. “Unfortunately, amid discussions on that bill, we’ve seen the usual Washington parlor game of wild speculation, unfounded rumor and uninformed comments by unnamed sources, some directed at me,” Nelson said in a lengthy statement put out yesterday. “Today, Washington is a cesspool of gotcha politics. It’s so out of control you can’t even shake hands in the hallway with a Future Farmer of America without people questioning your motives.”

Nelson went on to explain how his provision is important to not only Berkshire Hathaway but Caterpillar, 3M, ConAgra, the U.S. Chamber of Commerce and the Walt Disney Company (yet, oddly, we didn’t see Florida Bill Nelson blocking the bill on behalf of Walt Disney or Missouri’s Claire McCaskill opposing it for Caterpillar). Nelson noted that the U.S. government shouldn’t be in the business of rewriting existing business contracts and said that all outstanding derivatives – and Berkshire Hathaway has some $63 billion of them – should be grandfathered in and not subject to the new regulations.

Nelson may have a point but, unfortunately for him, his party is still a little burned from the last Cornhusker Kickback during health care reform – a sweetheart deal so universally condemned by Republicans, Democrats – even President Obama – that Nancy Pelosi considered using the Slaughter solution rather than let her members be tainted for having voted for it. In the end it was stripped out by the House reconciliation amendments.

Because of that unpleasantness, Nelson’s requests and amendments are now closely watched – and it doesn’t help when he’s the only high profile Dem holdout on a big vote. He could be asking for money for kittens and puppies and orphans these days and someone will still pounce and call it a Cornhusker Kickback. Those Nebraska puppies – why should they be saved any more than puppies across the country?! But in this case, in addition to Nelson’s personal stock, Berkshire Hathaway has long been Nelson’s largest donor, giving more than $75,000 over the years, as The Post points out today. Nelson makes it hard for leaders to include his provision because the last thing they want is national uproar over Cornhusker Kickback #2. And he should be careful: in an election the most dangerous thing is allowing your opponent to define you first. Nelson’s not up till 2012 but he’s already in trouble in Nebraska polls and the more he’s seen as a greedy grubs, the more trouble he’s going to have at home.

    I’m SHOCKED to learn that there was gambling going on at the casino!

    Fortunately, as I’ve been stressing the R and Dem versions of the bill aren’t too far apart and a few Republicans I’m sure would be delighted in voting down any Neslon amendment at the expense of supporting the final bill.

    .
    3M sells pharmeceutical precursers, oil based products, and chemicals
    .
    ConAgra sells foodsuffs and bulk agricultural products
    .
    The US Chamber of Commerce provides information and outreach, as well as advice and support for businesses and their customers
    .
    Walt Disney, or course, is a filmmaker and media provider
    .
    Did anyone notice that in this list, no one has derivatives as even a secondary set of products?
    .
    That is because derivatives are an easy way to make money on the side, and has nothing to do with any of these companies’ core products.

    The man has no shame. I’ve read reports from his filings that he and his wife owns between $1.5m and $6 m worth Berkshire Hathaway shares. Now, if that doesn’t show him up nothing will. Talk about vested interests: no wonder he is invested in self-service.

    I think after getting stung over the HCR deal, Nelson is going to find himself on the receiving end of the new strategy the Dems appear to have worked out.

    Backroom deals are made because supposedly there is no political downside, due to their very nature. Backroom deals with Nelson no longer have that quality, I think, and therefore, I agree that no deal is really to be expected here.

    Oh and to tie this in with Financial Reform, Goldman Sachs has a big involvement with all of this too. The new “exhange” has so many current and former Goldman Sachs employees involved it is difficult to know whether Goldman is going to get out of Wall Street and move to Chicago with this new exchange or stay put where they are now.

    You’re right – Caterpillar just has huge branches in Missouri. I associate them with Missouri because a few years ago Kit Bond went ballistic over air quality standards for lawnmowers that Caterpillar manufactures in Missouri.

    The legislation being put forward by the Democrats is nothing to get ecstatic about. True to form, what they have offered is such a cowardly watered-down version of what is really needed that it is hardly worth more than a halfhearted thumbs up. Essentially what they have come up with is a band-aid for a blood bath. I think it is revealing that even in this moderate and mushy form, the bill is too much for the Republicans to stomach. They want their “clients” to be given license to plunder our national treasure. You don’t agree with that? Then please explain to me what else could possibly be the motivation behind their opposition. It makes no sense otherwise. None.

    In recent weeks Republican members of the House and Senate – John Boehner and Mitch McConnell in particular – have been meeting privately with the big wigs from Goldman Sachs (among others) in order to kill any reform legislation. When McConnell tells us that the purpose of those meetings was to improve the proposed legislation (Let’s get real, shall we?) that doesn’t even come close to passing the the giggle test. I was born very early in the morning, but it wasn’t this morning. These people no longer even make any pretense as to who they’re really working for – and it isn’t us. We might as well stop kidding ourselves.

    Liberals and Conservatives alike name call and throw insults at each other in this blog. Yet you are the only one – left or right – who whines about the name calling and insults.

    Your criticisms would have much more merit, first, if you did not engage in the same practice, especially the name calling, which is so obvious. Second, if you held Conservative bloggers to the same standards.

    No one, no one, except “Exiled” have criticised someone on his/her side of the left/right debate. If fact, it seems Conservatives are much more likely to give another Conservative a slap on the back for coming up with a good insult of a Liberal.

    Do I call out Liberals? No. Do you call out Conservatives? No. So why do you hold me to a completely different standard?

    The irony, is that I don’t remember seeing any Conservative challenge another Conservative’s position. Now I have seen Liberals debate among themselves, albeit, in a very respectful manner.

    The sad fact is, I have posted challenging our Conservative friends to respond to a post. These posts are generally respectful of your intelligence and usually ask for ideas from Conservatives. To this day, I don’t remember ever receiving a response. We’ve seen the unregulated free market in action and it doesn’t work as advertised.     Assume, for the moment, that you have a home mortgage that you really like. The interest rate is fabulous and you are just really happy about the whole thing. You’ve never been late with a payment, and your credit rating is as high as it goes.

    Then how would you like it if Congress started messing around with contracts like home mortgages, and suddenly you were going to fact significantly higher payments.

    That is something like what is happening with Berkshire Hathaway. Contracts used to mean something — but the gang in Washington seems to think contracts can be unilaterally amended or thrown out entirely, if one party has a politically convenient argument.

    It would be great if Ben Nelson was sticking up for a principle, instead of just trying to get reelected. He is a little man, Warren Buffett is a giant. Nelson apparently recognizes this.

    In other threads it has been commonplace to trash people who attend public universities, like Boise State or the University of Alaska. Warren Buffett’s BS in economics is from the Univesity of Nebraska… so apparently an Ivy League degree is not necessary for success.

    During the recent crisis, Buffett did more to help the American economy weather the storm than either President Bush, President Obama, or anyone in Congress. Not as much as Bernanke, certainly, but when credit and blame are being dished out…

    A recent poll (unscientific) showed 80% trust Wall Street more than Washington. I know how to protect myself from Wall Street, but how can I protect myself from Washington? Washington can do far more damage to my current and future circumstances than Goldman Sachs, Berkshire Hathaway, or anyone else on Wall Street.

    tomdegan, don’t forget about Senator John Cornyn (Texas) of Texas, who’s in charge of the battle for election/re-election of Republican Senators this year. He flew up to NYC with Senator McConnell to meet with the Masters of the Universe about financial regulatory reform. (I’m especially aware of Senator Cornyn because I’m from Texas.)

    As for Senator Nelson, the man apparently is quite venal, perhaps entirely so. I don’t wish Nebraskans a raw deal, but neither do I wish them a sweetheart deal unavailable to the rest of us.

    Perhaps Senator Nelson’s perceptions of his senatorial role are different from mine (and a lot of other people’s, though I don’t know if they reach majority status). That is, though the Senate is a national body charged with looking after the nation, Senator Nelson apparently believes it’s better to say “To hell with the country as a whole — as long as I can take home the [vote-delivering] bacon before next election!”

    To be fair, he’s not only scarcely alone but is in the good company of 99 other Senators. I know my own — Cornyn, as I mentioned above, and Senator Kay Bailey Hutchison R-TX) certainly like the goodies for Texas. Senator Cornyn, in particular, likes to characterize federal money as dirty — but not too dirty to promise us in Texas. (In that, he’s closely aligned with our Republican Governor, Rick Perry.)

    Come to think of it, Senators Nelson and Cornyn would make a “good” pair, though the one’s Democrat and the other’s a Republican. Maybe if Puerto Ricans vote to become the 51st state, the two gentleman will decamp there, establish residency, and go on to represent that future state in the Senate.

    Forgot to add they can take Governor Perry with them — no telling when his shooting skills, which he demonstrated while jogging the other day, might come in handy!
